Terms and Conditions of Sale
1. Identification of the lessor

These General Terms and Conditions of Sale (hereinafter the “GTC”) apply to the reservation and seasonal rental of Villa Eden Roc (accommodating up to 10 people: 5 bedrooms, 5 bathrooms, kitchen, living room, outdoor area, game room, swimming pool) located at the address above.
2. Purpose and scope
These GTC aim to define the rights and obligations of the parties in relation to the seasonal rental of Villa Eden Roc. Any reservation made via the website implies the Client’s (the “Tenant”) full acceptance of these GTC.
3. Reservation procedure
- Reservation: Reservations are made exclusively via the Eden-roc-mallorca.com website. Payment must be completed in full at the time of booking.
- Payment Methods: Payment can be made by credit card or bank transfer.
- Confirmation: The Client will receive a confirmation email summarizing the rental details, the amount paid, and the dates of stay.
4. Cancellation and refund policy
- More than 60 days before arrival: Full refund of the stay by the host, with a deduction of (Stripe) bank fees of 3.25%.
- Less than 60 days before arrival: No refund will be granted, regardless of the reason for cancellation.
- Early Departure: If the Client leaves before the scheduled check-out date, no refund will be provided for the unused nights.
5. Rates and tourist tax
- The tourist tax (Ecotasa) is included in the rental price and is collected automatically.
- Rates may vary depending on the season and the number of nights booked. Only the rates displayed at the time of reservation are binding.
6. Security deposit (Caution)
- A security deposit of €2,000 is required. This is processed as a credit card imprint by the Stripe payment service at the time of booking.
- At the end of the stay, if no damage is found and all conditions are met (cleaning, respect of the premises, etc.), this deposit is refunded within a maximum of one week.
- In the event of damage, deterioration, or breach of conditions, part or all of the deposit may be withheld to cover repair or replacement costs.
7. Stay policies
- Minimum stay: From 2 to 5 nights, depending on the season.
- Check-in time: Between 4:00 PM and 7:00 PM.
- Check-out time: Between 9:00 AM and 11:00 AM.
- Any late departure affecting cleaning schedules or the next guests’ arrival may result in a fee of €120 per additional hour after 11:00 AM. The Client must ensure they vacate the villa by 11:00 AM on the departure day.
8. House rules
- Number of occupants: The maximum capacity of the villa is 10 people. This limit must be observed throughout the stay. Any external visitor not officially registered at check-in is prohibited without the Lessor’s prior consent.
- Non-smoking: Smoking is strictly forbidden inside the property.
- Pets: No pets are allowed in the villa.
- Parties and noise disturbance: Parties and events are not permitted. Outdoor music and noise must stop at 11:00 PM to respect the neighborhood. In case of non-compliance, the police may be called, and a fine charged to the Tenant. In the event of serious misconduct (unauthorized parties, unregistered guests, noise exceeding 90 dB outdoors after 11:00 PM), the Tenant may be evicted at the Lessor’s request without any refund for the remaining stay.
- Children: Children between 1 and 12 are welcome but remain under the full responsibility of their parents or accompanying adults (extra care is advised around the pool).
- Maintenance and housekeeping: Staff may enter the premises at any time to perform maintenance or address technical issues.
- Damage reporting: The Client must promptly notify the Lessor of any malfunction, damage, or accident during the stay.
- Events, photo/video shoots: Events, professional filming, and photo shoots are prohibited without prior written authorization.
- Pool and facilities: The Client is fully responsible for their own safety and that of their guests when using the pool. The Lessor disclaims all liability in the event of accidents or injuries.
9. Lessor’s obligations
- In case of a breakdown or malfunction, the Lessor will act promptly to resolve the issue. No compensation can be claimed if the problem is resolved in good faith.
10. Liability
- The Lessor cannot be held liable for any accidents, injuries, or material damages suffered by the Client or other occupants during their stay, particularly when using the pool or other amenities.
- Under no circumstances can the Lessor be held responsible for service interruptions beyond their control (internet outages, water or electricity cuts, etc.).
11. Client insurance
- The Client is advised to take out holiday rental insurance or suitable liability insurance to cover any incidents (theft, accidents, material damage, etc.).
12. Force majeure
- Neither party will be held responsible for delays or inability to fulfill their obligations under these GTC in the event of force majeure.
- In cases of force majeure (e.g., inability to access Mallorca due to armed conflict or a pandemic leading to airport closure), an amicable solution will be proposed to the Client, either by postponing the stay dates or providing a refund.
13. Governing law and jurisdiction
- These GTC are governed by Spanish law, specifically the provisions applicable in the Autonomous Community of the Balearic Islands.
- In case of dispute and failing an amicable resolution, the courts of Mallorca (Balearic Islands) shall have exclusive jurisdiction.
14. Personal data protection
The processing of the Client’s personal data is governed by our Privacy Policy, in compliance with the GDPR and LOPDGDD. Please refer to it for information on the collection, use, and protection of your data.
15. Acceptance of the GTC
By proceeding with the reservation, the Client acknowledges having read and unreservedly accepted these General Terms and Conditions of Sale. The GTC are available at any time on the eden-roc-mallorca.com website and take precedence over any other document or prior exchange.
